The following is valuable information for contractors working in the Central Desert region.

Visiting Communities

When you visit a Central Desert community as a contractor we would like you to please:

  • Tell the Council Service Manager (CSM) at least one week before your visit why you want to come, what you plan to do, who you would like to see, how long you plan to stay and what help you would like.
  • Check again a day before you come in case something unforeseen has happened, for example Sorry Business.
  • Reschedule your visit if the CSM gives you a reasonable explanation about why staff cannot meet with you or help you at the time you plan to visit.
  • Respect travel restrictions because of law and culture business.
  • Slow down and follow the speed signs.
  • Do not bring alcohol to communities.
  • Report to the Council office before doing any work and ensure you are provided with a local briefing.
  • Respect cultural areas and do not enter restricted areas.
  • Be flexible.
  • Keep your meetings brief.
  • Pay for the use of Council offices, accommodation, equipment (if available), and waste disposal (see below if applicable).
  • Do not ask for Council staff out of hours, except for emergencies.
  • Respect the privacy of residents’ camps and houses.
  • See the CSM before you leave.

Contractor Waste

Requirements Before Disposal of Demolition Waste

Prior to commencing the demolition works, the contractor must:

  1. Obtain an Asbestos Audit Certificate from a competent person for all the dwellings earmarked for demolition.
  2. Contact the Council Services Program Manager or Coordinator at the Community to:
    • Present the Asbestos Audit Certificate from a competent person.
    • Fill in the Contractor Waste Estimate Form available at Contractor Waste Estimate Form - v2 2024
  3. The filled in form must be handed to the Council Services Program Manager or Services Coordinator at the time of disposal of waste.
  4. Contractors should separate the waste as far as possible. This helps in further processing.

Background and General Principles

The Council is committed to service delivery across the organisation. In order to expedite the performance of its powers and duties to ensure efficient management it delegates some of its authority to the CEO. The CEO in turn has further delegated some of these roles and responsibilities.

This register records all delegations made by the Council or the CEO, periodic reviews are undertaken in conjunction with reviewing Council’s Policies.

Principles governing the use of delegated authority.

  1. Any exercise of delegated authority is subject to compliance with
    • any relevant provisions of the Local Government Act and Regulations (the “Act”)
    • any other legislative requirements applying to the Council
    • any applicable Council policy
    • any relevant and lawful resolution of Council
    • It is the responsibility of the officer exercising delegated authority to be aware of any restrictions on the exercise of that authority and to comply with the restrictions.
  2. Delegated authority should not be exercised where a conflict of interest exists or where it may be perceived to exist. This would extend, for example, to signing a leave form for oneself. The delegated decision can be forwarded to the next higher level of management for consideration.

  3. Delegations made cannot be passed on except by either the Council or the CEO. If the delegated officer is absent, unless authorised by the CEO, the decision can only be made by the next higher level of management.

  4. Delegation by the Council to the CEO does not prevent Council from acting itself.

  5. Delegation by the CEO likewise does not preclude the CEO from acting or revoking or varying the delegation at any time.

  6. Delegation requires judgment. It is not appropriate to exercise delegated authority in all circumstances and some decisions, which may be contentious or attract high public interest or where no clear policy guidelines exist should be referred to the CEO or Council as appropriate.

  7. At all times when exercising delegated authority are required to act reasonably.

  8. Delegations are made to a position, Committee or Local Authority, no specific delegation is made to an individual unless specifically stated. Anyone acting in a role will only receive delegations pursuant to number 3 above.

  9. If there is no delegation listed in this register, then the action can only be taken by either the Council or the CEO dependent upon the Act and the following discussion on the delegations made to the CEO.

  10. Unless otherwise stated, a delegation can only be exercised by the delegated officer in relation to the services of Council for which they have responsibility and does not extend to other Departments or Directorates

Delegations

Delegations by the Council (clause 32 of the Act)

The Central Desert Regional Council at its Monday, 23 June 2025 Special Council Meeting delegates to the Chief Executive Officer, pursuant to clause 40 of the Act, the following:

  1. Subject to the exclusions listed below, the exercise of the powers, functions, duties and authorities of Council as specified in:

    1. The Local Government Act;
    2. The Local Government Regulations and Guidelines;
    3. Any other Acts and legislative instruments, under which Council has powers, authorities, duties and functions; and
    4. Council's Decisions, Policies, Plans and approved Budget.

The role and functions of the Chief Executive Officer contained in clause 167 of the Act are not affected by these delegations.

Exclusions

The power to:

    1. expend monies not included within budget;
    2. levy, make or fix rates, valuations, charges, fees, fares, dues or rents;
    3. Borrow money;
    4. Determine Elected Members' allowances under Council’s Policies;
    5. Adoption of the Council’s Regional Plan or a revision to the Council's Regional Plan or budget;
    6. make an application, under the Act, to the Administrator or Minister for the appointment of a Chief Executive Officer;
    7. the appointment or termination of an Auditor and determination of the Auditor’s fee;
    8. the appointment of a Deputy President;
    9. the determination of a periodic review of electoral representation by Council;
    10. the determination of where Council Committee/Local Authority meetings are held;
    11. the establishment of any Council Committee/Local Authority and approval of an appointment to the position of Chairman of any Council Committee/Local Authority;
    12. the giving of directions or imposing of restrictions in respect to the calling and conduct of a Special meeting of a Committee/Local Authority of Council;
    13. the compulsory acquisition, purchase, sale, exchange or surrender of any land;
    14. sale of assets where the estimated disposal value was not included in the Council’s approved budget;
    15. the adoption of a financial statement included in an annual financial report;
    16. rating concessions under clause 250 of the Act (concessions relating to public benefit);
    17. To make By‐laws.
    18. Accept a tender where no report has previously been made to Council on the subject matter or estimated value.

Delegations by the Chief Executive Officer (clause 168 of Act)

  1. Pursuant to clause 168 of the Act, the Chief Executive Officer may sub–delegate to other employees of Council. All such delegations are as recorded in this delegations register.

Note:-

All dollar figures quoted within the following list of delegations are exclusive of GST, if applicable.

Where delegated authority is assigned to DCEO(Deputy CEO), CFO and Directors.

In exercising a delegated authority to fund purchases, it is the responsibility of the officer:

  1. approving a purchase order to ensure availability of funds and compliance with legislative and policy requirements;
  2. to ensure they have no conflict of interest in signing;
  3. approving payment of an invoice to ensure that the specific goods or services ordered have been received;
  4. To ensure legislative, policy requirements or delegations are not circumvented by order splitting.

The types of decisions where a delegation is needed are broad and include any matter in relation to the powers of Council or the CEO established under the Local Government Act, Local Government Regulations and many other Acts. As a corporate body, the Council acts by delegating its power to Local Authorities, Committees or the CEO. The powers of Council and the CEO include all aspects of running any business including setting the strategic direction of the organisation (set by the Council) and the day to day management of the organisation (managed by the CEO pursuant to clause 167 of the Act).

Specifically, times where a delegation is needed to act include, but are not limited to:

  1. decisions where there is a direct or indirect financial impact to the Council (i.e. incurring expenditure),
  2. deciding on service provision (including acceptance of grants/contracts),
  3. employing and managing staff, public relations (including protecting Council's reputation),
  4. Ensuring Council's community members are kept informed of the actions of Council etc.
